Let's review in simple terms what Chief Justice Roberts wrote about the Obamacare law.
1. Obamacare is not allowed under the Commerce Clause because it tries to regulate a "non-activity" and the Constitution and 200 years of Supreme Court case law says that only ACTIVITY can be regulated under the Commerce Clause -- non-activity cannot be regulated because the Constitution speaks of regulating, nor compeling, commercial activity.
Here are Chief Justice Roberts words: "The Framers gave Congress the power to regulate commerce, not to compel it, and for over 200 years both our decisions and Congress’s actions have reflected this understanding. There is no reason to depart from that understanding now."
2. Because the Court ruled out declaring Obamacare constitutional under the Commerce Clause, they had to find another reason to support it constitutionally. That made it very important to answer the question, "is it a tax or penalty" that must be paid by almost everyone who does not buy health insurance.
In the Majority Opinion, Chief Justice Roberts said that even though the word used in the operative part (not the beginning explanatory part that has no force of law) was "penalty", that is not determinative of whether the "payment" is really a tax or a penalty. If Roberts had said that the payment is a penalty, Obamacare would be unconstitutional . Why? Because since the Commerce Clause didn't save Obamacare, only a "tax" reading could. A penalty reading, that is, a payment for an unlawful act or refusal to act, would have made Obamacare unconstitutional.
Here are Chief Justice Roberts' words: "Congress’s authority under the taxing power is limited to requiring an individual to pay money into the Federal Treasury, no more. If a tax is properly paid, the Government has no power to compel or punish individuals subject to it. We do not make light of the severe burden that taxation — especially taxation motivated by a regulatory purpose — can impose. But imposition of a tax nonetheless leaves an individual with a lawful choice to do or not do a certain act, so long as he is willing to pay a tax levied on that choice. The Affordable Care Act’s requirement that certain individuals pay a financial penalty for not obtaining health insurance may reasonably be characterized as a tax. Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness."
The Dissent puts the tax question in the clearest possible terms: "We never have classified as a tax an exaction imposed for violation of the law, and so too, we never have classified as a tax an exaction described in the legislation itself as a penalty. To be sure, we have sometimes treated as a tax a statutory exaction (imposed for something other than a violation of law) which bore an agnostic label that does not entail the significant constitutional consequences of a penalty — such as “license” or “surcharge”. But we have never—never—treated as a tax an exaction which faces up to the critical difference betweena tax and a penalty, and explicitly denominates the exaction a “penalty.” Eighteen times in §5000A itself and elsewhere throughout the Act, Congress called the exaction in§5000A(b) a “penalty.”
Now, to the problem with calling the Obamacare payment a tax. It means that President Obama and his administration are caught in a vise. They insist that the payment is a penalty. IF IT IS, then Obamacare just lost its only possible constitutional support. Obamacare would have been declared unconstitutional. So, in trying to prevent being accused of imposing major new taxes on the American people, Obama has said all along that the payment is a penalty.
But, now, the President is faced with the reality that the Supreme Court has found that the payment is a tax, thus giving Obamacare justification under the Constitution. If Obama continues to argue that the payment is a penalty, he is simply saying that Obamacare is unconstitutional.
That is the importance of Mitt Romney's statement that he agrees with President Obama, i.e., the payment is a "penalty." What Governor Romney is saying is that Obamacare is unconstitutional. He is waving a red flag at the President, saying, I dare you to call your payment a tax and so admit that you imposed a huge tax on Americans, hoping it would save your Obamacare from being held unconstitutional.
I do not, cannot, understand the mock shock about Romney's statement. The TV pundits, Democrats, wannabe constitutional lawyers, and even some Republicans, are simply showing their inability to follow reasoning to its logical conclusion. Or they are being deceitful and really want Obamacare to continue.
Mr. Romney said in Massachusetts that the payment was a penalty. He could do that because the MassachusettsCare was not subject to being considered under the Constitution. He was right then. He is right now.
For goodness sake, GOP, get your heads screwed on right and agree with him. Force President Obama to defend a tax that is really a penalty. Make him say, "Yes, it's a tax"...bring down the anger of America on this new large tax burden.
And, force the President to admit that his legislation was originally drafted in a way that would make it unconstitutional...that it is unconstitutional... and ought to be repealed by Congress. Because that is the alternative to Obama's being forced to agree that Obamacare is a huge new tax.
It is a pure "gotcha". The President is damned if he does and damned if he doesn't.
Up until 2 minutes ago I had NO understanding of how anyone, even the lame brains that are presently governing this nation could tax anyone for something they don't do (ie: I drive a car, I pay various taxes, I own a home, I pay taxes, I buy clothe, sales tax, and on, and on).

A dumb question: So do you think that possibly Roberts had a sinister thought and acted upon it? I do not as a life long conservative republican understand the problem that the GOP is having with getting on board with Romney. Sure he's not Reagan, who is.Dynamic he may not be to most; but this is an election not a beauty contest. If you look back at when there was 13 or so GOP candidates and Obama, who else is better suited to be president - NO ONE.

Law School 101 – “When you get the issues wrong, you get the outcome wrong”.
ReplyDeleteWe are now at some 5 days/120 hours post the announcement of the Supreme Court decision. And I am not convinced at all that there is an absolute understanding of the opinion from the majority by either the legal communities or the lay people. NO ONE still is speaking with any absolute clarity or consensus as to what occurred outside of the fact that the court in all its wisdom said in some mumble jumble terns that if “we the people “leave Obama in office then Obamacare is the law of the land. And maybe that is all us non leagaterians (my word) should know.
Is it at all beneficial from here on to November 6th that we know why every “T” was crossed, every “I” doted, and why every comma was placed where it was? NO it is not. It is certainly compulsory that every straight forward, honorable practicing lawyer has a full grasp of it. But “we the people” need not. Do any of us understand everything in Row v Wade, The Dread Scott decision, Brown vs. The Board of Education, The Civil Rights Act of 1964? I doubt it. What we do understand and rightfully so is that these and hundreds of other land mark decisions by the Court are the law of the land until another court decision is rendered thereby changing the law of the land.
But we are lucky. Come this November 6th, the people have the enormous opportunity to directly launch the process that will establish the rule of the land in health care by casting our vote (votes if you lucky enough to live in Chicago) for Mitt Romney. He has vowed to overturn this Obama care debacle, this misunderstood Supreme Court decision, and Chief Justice’s John Roberts illusory maneuver. We can right the leaning ship, move on to our economic problems, set course to undue other Obama policies that are treacherous to our country with one simple “X” on our ballot.
Don’t be misled into thinking that this coming election is about anything other than the elimination of one Barrack Obama and his band of merry men who are out doing the foul and despicable deeds of the Sherriff of Nottingham, one George Soros. Let us one and all understand that these people are in lock step to bring about a vast negative change to this great nation. A nation that declared it’s independence to the world in the document that started with the phrase – “WE THE PEOPLE”; a nation that since its inception has stood up against evil wherever it raised its ugly head. We are the nation that saved all of Europe (twice) from the tyrannous evil German dictators of the past century. We stepped up in the Pacific to defeat the immoral elements of the then Japanese regime that saw it their right to overrun and slaughter millions of simple citizens of neighboring nations. They put a whole new meaning to the Oklahoma Land Rushes of old.
Please fellow readers of Casey Pops get out the vote on November 6th. It does not matter if the people you influence to vote are republicans, democrats, independents, libertarians, white, black, young, old Christian or Muslim. If they agree in our cause of the repeal of Obamacare and the re-establishment of freedom for one and all, if they are immigrants let’s give them back the country they came here to be part of - make sure they vote. They can vote for anything or anybody else the way they want to. But it is imperative for Mitt Romney to be elected and as many like minded Congressmen and Senators as humanly possible.

ReplyDeleteNone of us have any idea at all where we will be on November 7th. But there will be freedom loving men, women and children here if we are not. Vote for them. Let our legacy be FREEDOM for one and all FOREVER.
I am passionate about my country and what I leave behind for those that follow me. I answered the call when no one was calling. In my time the danger was from without. Today it’s from 1600 Pennsylvania Ave. The terrorists that brought temporary destruction upon our sense of security and justice can be handled, even somewhat eradicated if necessary. We cannot and will not become a nation with slaughtering violence in our street; elimination of dissenting voices by violent actions. We are a nation of laws (even if we lay citizens do not understand the English they are written in.
There was a time in my life that I saw merit in the statement –“My Country Right or Wrong, But My Country”. Those blinders I use to wear are long gone. Honorable people don’t condone such stupidity. Are you discussed by adultery then play golf with a friend who cheats on his wife/family. How do we forget what Tiger did just because we like his style of playing the grand and honorable game championed by Arnie, Jack, Bobby,,etc.
I am appalled that nearly every news cast has some article concerning the depart of another high ranking leader from the business world, a political scandal, a coach molesting his kids, teachers having sexual relations with their students, and on, and on. Where are we at today? Morality is an unused word. Honor is laughed at. Decency in actions and dress is taboo. Peer pressure and bullying today is a force that drives our young to suicide, to turn to drugs, alcohol or simply joining in. We have got to stop his downward spiral we’re in. I am a Christian; I am NOT a religious fanatic. Sad to say I don’t even go to church every week. I do pray every day. I try to live an honorable life; the same way that my grandparents did.
Excuse me for my lengthy dissertation here today. Some of you may think that I have strayed from topic. But for the next 4 months and 6 days the defeat of Obama and eventually Obamacare when Mitt Romney takes office is paramount. It is totally unimportant about baseball, football, what actress is divorcing what actor, what Kim is not wearing, etc. It does really matter who Mitt Romney chooses for his running mate. If an elevation of the VP to the presidency occurs we can deal with it; later. Right now we must concentrate on Mitt Romney being in the White house on January 20th to undo the potential devastating harm Obama wants to orchestrate for the USA.
I must stop or Casey Pops will put a word limit on me. I hope Casey Pops that you are not charged for space by your Blog site provider. A rambling right wing conservative like me could break the bank.
